These Terms and Conditions (“Agreement”) govern all services provided by S.M HVAC Inc. (“Company,” “we,” “us,” or “our”) to the customer (“Customer,” “you,” or “your”).

By approving an estimate, signing a service agreement, or allowing work to begin, the Customer agrees to these Terms and Conditions.

1. Scope of Work

The Company agrees to provide HVAC installation, repair, maintenance, inspection, and related services as described in the written estimate, invoice, or service agreement provided to the Customer.

Any additional work requested beyond the original scope will require written or verbal authorization and may result in additional charges.

2. Estimates and Pricing
  • Estimates are valid for 30 days unless otherwise stated.
  • Pricing is based on current labour and material costs and may be subject to change.
  • Hidden conditions (including but not limited to concealed damage, code violations, or unsafe systems) may require additional work at additional cost.
  • All prices are subject to applicable taxes.
3. Payment Terms
  • Payment is due upon completion of work unless otherwise agreed in writing.
  • For installations, a deposit of 25–50% may be required prior to scheduling.
  • Accepted payment methods: debit, credit, e-transfer, cash, and cheque.
  • Late payments may incur interest at the maximum rate permitted by law.
  • The Customer agrees to pay all reasonable collection costs, including legal fees, if payment is not made as agreed.
4. Permits and Code Compliance
  • The Company will obtain required permits unless otherwise specified in writing.
  • Work will be performed in accordance with applicable local and provincial codes.
  • Any pre-existing code violations are not the responsibility of the Company unless specifically included in the scope of work.
5. Warranties

Labour Warranty

The Company warrants its workmanship for a period of two years from the date of completion.

Manufacturer Warranty

Equipment and parts are covered by the manufacturer’s warranty. The Company makes no additional warranties beyond those provided by the manufacturer.

Exclusions

The warranty does not cover:

  • Improper use or neglect
  • Lack of maintenance
  • Acts of God (flood, fire, lightning, etc.)
  • Unauthorized repairs or modifications
  • Pre-existing conditions
6. Customer Responsibilities

The Customer agrees to:

  • Provide safe and unobstructed access to work areas, including electrical panels, attic spaces, crawlspaces, and mechanical rooms.
  • Ensure pets are secured during service visits.
  • Provide accurate information regarding system history and issues.
7. Limitation of Liability

To the fullest extent permitted by law:

  • The Company shall not be liable for incidental, indirect, or consequential damages.
  • Liability for any claim shall not exceed the amount paid for the specific service provided.
  • The Company is not responsible for damage to concealed piping, wiring, ductwork, or structures not visible at the time of service.
8. Cancellation & Rescheduling
  • Customers must provide at least 24 hours’ notice to cancel or reschedule.
  • The Company reserves the right to charge a service fee for missed appointments.
9. Refund Policy
  • Service calls and completed repairs are non-refundable.
  • Installation deposits are refundable only if cancellation occurs before equipment is ordered. If equipment has been ordered, refunds may be subject to restocking fees and supplier charges.
  • Installed or special-order equipment is non-refundable.
  • Maintenance plans are refundable only if no services have been provided. If services have been performed, refunds will be prorated.
  • Any service concerns must be reported within 7 days of completion. The Company will be given an opportunity to inspect and resolve the issue before any refund is issued.
  • Approved refunds will be processed within 10–14 business days and issued to the original payment method.
10. Acceptance

These Terms and Conditions, together with any written estimate, proposal, invoice, or service agreement, constitute the entire agreement between the parties.

By signing or authorizing work to begin, the Customer acknowledges that they have read, understood, and agree to these Terms and Conditions.
